A wave of restrictions on protesting has been rippling through Australia\u2019s top universities.<\/p>\n

Over the past year, all of Australia\u2019s eight top research universities (the Group of Eight<\/a>) have individually increased restrictions on campus protests.<\/p>\n

The changes include bans on\u00a0indoor protests<\/a>\u00a0and\u00a0restrictions on banners<\/a>, posters and\u00a0student announcements<\/a>. At some campuses, groups\u00a0need to give notice<\/a>\u00a0or obtain university approval if they are going to protest.<\/p>\n

Why has this happened and what does it mean for protests, free speech and democracy at Australian universities?<\/p>\n

Why are university protests important?<\/strong><\/h4>\n

Over the past 60 years, campus protests have been a\u00a0defining feature<\/a>\u00a0of\u00a0Australian university life<\/a>.<\/p>\n

In the 1960s and \u201870s, they were a\u00a0breeding ground<\/a>\u00a0for\u00a0social protest<\/a>, including rallies against apartheid and the Vietnam War, and in favour of women\u2019s rights. In more recent years, students have protested on key social, political and environmental issues, from university fees to the invasion of Iraq and climate action.<\/p>\n

This protest history feeds into the\u00a0broader purposes of universities<\/a>. Universities act as a modern-day \u201cpublic square<\/a>\u201d. This means they are a place\u00a0where ideas can be freely debated and difficult issues can be explored<\/a>. In this way, they act as a key component of a free and healthy democracy.<\/p>\n

As Victorian university legislation\u00a0notes<\/a>, universities should promote<\/p>\n

critical and free enquiry, informed intellectual discourse and public debate within the University and in the wider society.<\/em><\/p><\/blockquote>\n

Restricting protests for campus safety<\/strong><\/h4>\n

Since early 2024, there have been increasing restrictions on campus protests.<\/p>\n

These come in the wake of the\u00a0months-long encampments<\/a>\u00a0protesting the war in Gaza \u2013 and\u00a0ensuing concerns over antisemitism<\/a>\u00a0at universities and campus safety.<\/p>\n

They have also coincided with increased\u00a0public scrutiny over university governance<\/a>. This includes accusations vice-chancellors are running a \u201clawless sector<\/a>,\u201d pointing to\u00a0underpayment of staff<\/a>, high levels of\u00a0executive pay<\/a>\u00a0and\u00a0criticism of the way some universities managed the protests<\/a>.<\/p>\n

What have universities done?<\/strong><\/h4>\n

In this heightened context, universities have increased restrictions on campus protests, arguing they are needed for safety.<\/p>\n

Universities have taken various measures. For example, the University of Western Australia has\u00a0restricted student announcements in class<\/a>\u00a0(or \u201clecture-bashing\u201d).<\/p>\n

To ensure safety and wellbeing, student announcements are not permitted at the commencement of lectures or other teaching and learning activities.<\/em><\/p><\/blockquote>\n

The University of Adelaide has\u00a0banned student encampments<\/a>\u00a0and indoor protests.<\/p>\n

The changes across the Group of Eight mean students announcing a rally for climate action in class now risk disciplinary action at some universities. Sit-ins calling on universities to divest from weapon companies are no longer permitted at others. At some campuses, union members going to stop-work meetings to protest staff cuts could be engaging in employee misconduct.<\/p>\n

The legal basis of the restrictions<\/strong><\/h4>\n

Australian universities are typically set up under state legislation and through this have broad powers to regulate campus protests.<\/p>\n

They can impose obligations on students through university rules and\u00a0direct their staff as employers<\/a>. They can determine who is allowed to enter and remain on campus through their powers to\u00a0manage land they either own or control<\/a>.<\/p>\n

Universities in\u00a0South Australia<\/a>\u00a0and\u00a0Victoria<\/a>\u00a0also have powers under state legislation to make university statutes and regulations.<\/p>\n

The protest restrictions have relied on a mix of these powers.<\/p>\n

Could these changes be challenged?<\/strong><\/h4>\n

But these restrictions are also subject to enterprise agreements made under the federal\u00a0Fair Work Act<\/a>\u00a0which protect academic and intellectual freedom. For example, the University of Sydney\u2019s\u00a0enterprise agreement<\/a>\u00a0entitles staff to:<\/p>\n
