Shortly after taking office, US President Donald Trump issued executive orders<\/a>\u00a0banning federal funding on so-called \u201cwoke\u201d research.<\/p>\n

This is part of his\u00a0broader ban on all diversity<\/a>, equity and inclusion (DEI) policies, grants and programs in the US government.<\/p>\n

These orders are massive in scope,\u00a0impacting studies<\/a>\u00a0as varied as stroke recovery, computing and ancient languages.<\/p>\n

The impact in the United States so far has been dramatic. Some universities are already\u00a0cutting student admissions<\/a>\u00a0and looking at ways to\u00a0shed academic staff and researchers<\/a>.<\/p>\n

Now the ban has\u00a0impacted Australian researchers<\/a>\u00a0who have links to US government-funded projects. The Trump Administration is asking for information\u00a0on how their research fits in<\/a>\u00a0with US foreign and domestic policy.<\/p>\n

What has happened?<\/strong><\/h4>\n

The US government has\u00a0sent a 36-point questionnaire<\/a>\u00a0to some Australian researchers who are working on joint projects with US colleagues.<\/p>\n

ABC Radio National\u00a0reports<\/a>\u00a0at least eight Australian universities are involved. Their research areas include foreign aid, medicine, vaccines and defence. The New York Times\u00a0reports<\/a>\u00a0a similar document has also been sent to other overseas organisations with US funding links.<\/p>\n

The questions are wide-ranging and cover academics\u2019 links to China as well as their projects\u2019 focus on topics such as diversity, inclusion and gender identity, as well as climate change.<\/p>\n

Some of the specific questions include:<\/p>\n

Can you confirm that your organisation has not received ANY funding from PRC\u00a0People\u2019s Republic of China<\/a>, Russia, Cuba or Iran?<\/em><\/p>\n

Can you confirm that this is no DEI [diversity, equity and inclusion] project or DEI elements of the project? [sic]<\/em><\/p>\n

Does this project take appropriate measures to protect women and to defend against gender ideology as defined in the below\u00a0Executive Order<\/a>?<\/em><\/p>\n

Can you confirm this is not a climate or \u201cenvironmental justice\u201d project or include such elements?<\/em><\/p><\/blockquote>\n

The survey also covers issues such as secure borders with Mexico, ending government waste, terrorism, the war on opioids, and \u201ceradicating anti-Christian bias\u201d.<\/p>\n

Read<\/a><\/p>\n

Concern and anger<\/strong><\/h4>\n

In response, the\u00a0Group of Eight<\/a>\u00a0(which represents Australia\u2019s top research universities) and\u00a0Australian Academy of Science<\/a>\u00a0have separately raised concerns with the Australian government about the survey and its impact on Australian research.<\/p>\n

The Group of Eight says the US has already suspended or terminated research grants with six of its eight member universities.<\/p>\n

The National Tertiary Education Union also\u00a0labelled the survey<\/a>\u00a0\u201cblatant foreign interference\u201d.<\/p>\n

A spokesperson for Education Minister Jason Clare says Australia is \u201cengaging with the US government to understand what these measures mean for future funding and collaboration\u201d.<\/p>\n

Are Trump\u2019s orders legal?<\/strong><\/h4>\n

Trump\u2019s executive orders are currently the subject of\u00a0numerous lawsuits<\/a>\u00a0in the US. Plaintiffs say Trump\u2019s orders\u00a0violate the First and Fifth Amendments<\/a>\u00a0\u2013 those dealing with protection of free speech, equal protection and \u201cdue process of law\u201d when depriving a citizen of property.<\/p>\n

Whether Trump\u2019s orders are legal or not is a tricky question, and will likely come down the judges\u00a0hearing each case<\/a>.<\/p>\n

In the meantime, US government agencies are\u00a0withholding funding anyway<\/a>. Reports also suggests Trump has\u00a0instructed his administration<\/a>\u00a0to ignore court orders \u2013 hardly surprising, given Trump\u2019s\u00a0history<\/a>\u00a0of contempt of US courts.<\/p>\n

What does this mean for Australia?<\/strong><\/h4>\n

US involvement in Australian research is significant. According to the\u00a0Academy of Science<\/a>, US government research funding involving Australian research organisations was $A386 million in 2024.<\/p>\n

It is\u00a0arguable<\/a>\u00a0Trump\u2019s orders infringe Australian sovereignty. But the US has always had the capacity to interfere in Australian university research \u2013 it just hasn\u2019t actually done it until now.<\/p>\n

Research contracts signed between universities and funding bodies can contain all kinds of requirements, so US law can end up applying to Australian researchers. When the AUKUS deal was announced in 2021,\u00a0a huge question<\/a>\u00a0was how universities would comply with notoriously harsh US export control laws.<\/p>\n

The survey indicates it was issued by the\u00a0US Office of Management and Budget<\/a>\u00a0and appears to be supported by the US\u00a0CHIPS and Science Act<\/a>\u00a0(which authorises certain research investments) and National Science Foundation\u00a0policies<\/a>. So, while Australian researchers could potentially ignore these questionnaires, that would legally give a US funding body grounds to cancel the funding contract.<\/p>\n

Our foreign interference laws also\u00a0weren\u2019t designed<\/a>\u00a0for situations like this. Even if they did, Trump is the current head of the US government, and is likely to be\u00a0immune from prosecution<\/a><\/p>\n

Statutory tests for foreign interference \u2013 including criteria that such acts are covert, and\/or involve threats of harm \u2013\u00a0simply don\u2019t apply<\/a>\u00a0to a US president like Trump.<\/p>\n

So legally, it doesn\u2019t look like there is much Australia can do about Trump\u2019s orders.<\/p>\n

What can Australia do?<\/strong><\/h4>\n

Some newly unemployed researchers are now\u00a0poised to leave the US<\/a>, taking their research with them. This poses a potential security risk, with countries such as\u00a0China<\/a>\u00a0and\u00a0Russia<\/a>\u00a0both keen to capitalise on Trump\u2019s decisions.<\/p>\n

But other nations are also aware of the possibilities. The European Union has already\u00a0offered<\/a>\u00a0displaced US scientists a more \u201csympathetic place to work\u201d.\u00a0South Korea<\/a>\u00a0and\u00a0Canada<\/a>\u00a0are also marketing themselves as attractive options. Australia could follow suit.<\/p>\n

The federal government is currently\u00a0doing a strategic review<\/a>\u00a0of Australia\u2019s research and development system. This could make diversifying our research partners a national priority.<\/p>\n

This could include\u00a0revisiting a 2023 decision<\/a>, not to join Horizon Europe \u2013 the European Union\u2019s\u00a0key research fund<\/a>.<\/p>\n

Either way, given such radical changes in the US, Australia needs to seriously reconsider how it is funding and structuring research.<\/p>\n
