The Trump administration on Tuesday slashed staff at the Department of Education<\/a>\u00a0\u2013 firing roughly 1,300 employees \u2013 as part of its\u00a0long-planned effort to eliminate<\/a>\u00a0the agency entirely. The move leaves the department with\u00a02,183 employees<\/a>, down from more than 4,000 at the beginning of the year.<\/p>\n

The cuts also follow recent leaks that President Donald Trump was\u00a0planning to sign an executive order<\/a>\u00a0calling for the department\u2019s dismantling, based on drafts first\u00a0obtained by The Wall Street Journal<\/a>.<\/p>\n

Although the\u00a0president has broad executive authority<\/a>, there are many things he cannot order by himself. And one of those is the dismantling of a\u00a0Cabinet agency created by law<\/a>. But he seems determined to hollow the agency out.<\/p>\n

As an education expert<\/a>, who has written and\u00a0spoken widely<\/a>\u00a0on the push to privatize U.S. educational services, I see this latest effort as a residual campaign promise to abolish the department. It\u2019s also part of the\u00a0wave of executive actions<\/a>\u00a0creating legal and policy uncertainty around funding for children in local schools and communities.<\/p>\n

The draft order, in 2 parts<\/strong><\/h4>\n

On the surface, a demand to end the Education Department is nothing new.<\/p>\n

Trump\u2019s\u00a0campaign platform<\/a>\u00a0included a call to abolish the department. It\u2019s a call that literally began\u00a0Project 2025\u2019s<\/a>\u00a0education chapter as well.<\/p>\n

What\u2019s different now is Trump\u2019s apparent strategy of doing what he can to eliminate the department\u00a0on his own authority<\/a>\u00a0while seeking the congressional approval he legally needs.<\/p>\n

The drafted new order has two parts that follow this logic.<\/p>\n

The first directs\u00a0Education Secretary Linda McMahon<\/a>\u00a0to create a plan for eliminating whatever the administration can on its own. Under that section, McMahon is to pay special attention to any programs that might fall afoul of the administration\u2019s earlier\u00a0orders on diversity, equity and inclusion<\/a>\u00a0\u2013 or DEI \u2013 initiatives.<\/p>\n

The second part notes that these actions should follow existing law and administrative guidance. That amounts to an assertion of authority for Trump\u2019s\u00a0Office of Management and Budget<\/a>.<\/p>\n

Basically, it appears Trump is reminding everyone that he controls the Department of Education\u2019s operational budget. At the same time, I believe he is implicitly calling on Congress to finish McMahon\u2019s job by removing any lingering legal barriers to the agency\u2019s final dismantling.<\/p>\n

Whether Congress will do so is purely speculative, especially in the current political environment.<\/p>\n

In 2023, a bipartisan majority of U.S. House members voted down\u00a0a proposal to eliminate the Education Department<\/a>. But Joe Biden was president then. He almost certainly would have vetoed any such bill that passed anyway.<\/p>\n

It\u2019s a different calculus to ask what the House would do under pressure from Trump. But even now, the Senate also gets its say. And it would take 60 votes to break any Democratic-led filibuster and eliminate the department.<\/p>\n

A \u2018final mission\u2019<\/strong><\/h4>\n

So, in one sense, a Trump order would just reinforce what he\u2019s already done:\u00a0gut agency staff and halt activity<\/a>, while calling on Congress to finish the job.<\/p>\n

But that brings the focus back to the first part of the order: directing the new education secretary to identify places in the department Trump can cut on his own \u2013 or at least transfer to other agencies.<\/p>\n

As\u00a0the March 11 mass layoffs show<\/a>, it\u2019s not even clear such a plan is needed for McMahon to try to begin dismantling the agency.<\/p>\n

Even before these cuts, through Elon Musk\u2019s\u00a0Department of Government Efficiency<\/a>, the administration\u00a0all but froze<\/a>\u00a0a key piece of the Education Department: the\u00a0Institute for Education Sciences<\/a>, its nonpartisan research arm.<\/p>\n

And on her first full day on the job, McMahon sent a directive to department employees calling the dismantling of their agency a \u201cfinal mission<\/a>.\u201d To that end, the administration could decide to freeze hiring and some funding programs within the department.<\/p>\n

The Trump administration tried a version of this with the\u00a0federal Head Start program<\/a>, which helps low-income families prepare their pre-K children for school. But it\u00a0rescinded that plan<\/a>\u00a0in January alongside a pause on more general spending freezes across the federal government.<\/p>\n

The March layoffs are telegraphing an extreme move: a wholesale decimation of the Education Department, as Musk\u2019s team did to the U.S. Agency for International Development. That action\u00a0effectively shut down<\/a>\u00a0most of USAID, with a plan to house what remains under the State Department.<\/p>\n

Legal and policy uncertainty<\/strong><\/h4>\n

Whether any such activities are legal, even under a Trump executive order, is another question.<\/p>\n

They will all be challenged in court, adding to the flurry of lawsuits against the administration, many of which have\u00a0prompted federal judges<\/a>\u00a0to pause Musk\u2019s efforts in particular.<\/p>\n

On March 13, two days after the Education Department cuts, 21 Democratic attorneys general\u00a0sued the Trump administration<\/a>\u00a0over the layoffs, arguing they are \u201cillegal and unconstitutional.\u201d<\/p>\n

Then the question becomes whether Trump\u2019s team will even listen to any judicial demands to stop whatever plans they draw up for the Education Department. The administration is\u00a0openly questioning<\/a>\u00a0such judicial authority. And in at least one instance \u2013 when\u00a0ordered to release billions of dollars in federal grants<\/a>\u00a0\u2013 it has refused to comply.<\/p>\n

In other words, a Trump executive order to dismantle the Education Department will create considerable legal and policy uncertainty.<\/p>\n

It\u2019s well known that Trump and allies want to eliminate the department and that he cannot do so legally without Congress.<\/p>\n

The draft executive order seems to indicate that the\u00a0Trump administration acknowledges those limitations<\/a>\u00a0\u2013 at least officially. But the draft order and the department\u2019s mass layoffs raise the possibility that Trump might proceed anyway.<\/p>\n

About the only thing clear at the moment is that\u00a0billions of dollars<\/a>\u00a0in public educational programs across the country are at stake in the outcome of these decisions.<\/p>\n

And the extent to which Trump\u2019s latest directive has real consequences for that funding will be determined by the extent to which Congress voluntarily surrenders its own responsibility and authority in this space.<\/p>\n
