The International Criminal Court (ICC) recently issued\u00a0arrest warrants<\/a>\u00a0for Israeli Prime Minister Benjamin Netanyahu, former Israeli Minister of Defense Yoav Gallant and Hamas military commander\u00a0Mohammed Deif<\/a>\u00a0for war crimes and crimes against humanity.<\/p>\n A pre-trial chamber of the ICC found that there are reasonable grounds to believe that Netanyahu and Gallant intentionally \u201cdeprived the civilian population in Gaza of objects indispensable to their survival, including food, water, and medicine and medical supplies, as well as fuel and electricity.\u201d<\/p>\n This is not the first attempt to seek legal accountability for Israel\u2019s actions in the Gaza Strip. In December 2023,\u00a0South Africa brought a case at the International Court of Justice (ICJ)<\/a>\u00a0accusing Israel of committing genocide. In January of this year, the ICJ found there was a \u201creal and imminent risk<\/a>\u201d\u00a0that Israel was committing \u2014 or would commit \u2014 acts of genocide<\/a>\u00a0in Gaza.<\/p>\n Nine months later, a\u00a0United Nations Independent Commission of Inquiry reported<\/a>:<\/p>\n \u201cIsrael has implemented a concerted policy to destroy the health-care system of Gaza. Israeli security forces have deliberately killed, wounded, arrested, detained, mistreated and tortured medical personnel and targeted medical vehicles, constituting the war crimes of willful killing and mistreatment and the crime against humanity of extermination.\u201d<\/em><\/p><\/blockquote>\n As the world witnesses the ongoing destruction of Gaza, universities in the West have become critical sites of examination, debate and protest. They have also become\u00a0sites of suppression<\/a>\u00a0that shrink, rather than facilitate, the open exchange and analysis of ideas.<\/p>\n Universities are indispensable to supporting the free inquiry needed to do the work of addressing atrocity crimes. However, Western universities are increasingly prioritizing ideas of neutrality over a principled commitment to free speech and the pursuit of truth.<\/p>\n In an essay on education and neoliberalism, Canadian-American cultural studies scholar\u00a0Henry Giroux<\/a>\u00a0emphasized the importance of the university\u2019s role in leading social change. He said the university is: \u201cone of the few public spaces left where students can learn the power of questioning authority, recover the ideals of engaged citizenship, reaffirm the importance of the public good, and expand their capacities to make a difference.\u201d<\/p>\n Understanding \u2014 and ultimately preventing \u2014 genocide and other atrocity crimes requires\u00a0an interdisciplinary<\/a>\u00a0approach that incorporates insights from a multitude of areas of expertise including law, history, politics, hard and applied sciences, psychology, journalism and others. Universities are crucial to supporting the\u00a0evidence-based research<\/a>\u00a0needed to do this essential work.<\/p>\n \u201cThe chances for truth to prevail in public,\u201d as\u00a0Hannah Arendt argued<\/a>, are \u201cgreatly improved by the mere existence\u201d of universities and \u201cby the organization of independent, supposedly disinterested scholars associated with them.\u201d<\/p>\n Academic freedom should always be highly valued and steadfastly protected. As the Canadian Association of University Teachers\u00a0stated in November 2023<\/a>, \u201cacademic freedom, like all expressive freedoms, is particularly vulnerable during periods of war, conflict, and social unrest.\u201d<\/p>\n Unfortunately, many have responded to\u00a0political<\/a>\u00a0and\u00a0donor pressure<\/a>\u00a0by\u00a0repressing discussions of Palestine in the classroom<\/a>\u00a0and on campus grounds. These moves curtail the academic freedom of scholars working on Palestine.<\/p>\n When universities become less free, the\u00a0health of our democracies declines<\/a>.<\/p>\n Over the past year, students\u00a0across North America, Europe and elsewhere<\/a>\u00a0established encampments on campuses to\u00a0bring attention to Israel\u2019s crimes<\/a>\u00a0and to call on their institutions to divest from companies and industries associated with Israel\u2019s assault on Gaza and\u00a0occupation of Palestinian land<\/a>.<\/p>\n However, many encampments were violently dismantled, with\u00a0universities<\/a>\u00a0collaborating with authorities<\/a>\u00a0to shut down dissent and protest on campus.<\/p>\n Some universities have\u00a0targeted students<\/a>\u00a0and\u00a0faculty<\/a>\u00a0who support Palestinian freedom with\u00a0surveillance, reprisals and expulsions<\/a>. They have enacted a range of\u00a0new policies<\/a>\u00a0designed to discourage or otherwise police speech on campus, which\u00a0disproportionately target<\/a>\u00a0speech on Palestine. Such actions\u00a0violate the expressive<\/a>\u00a0and\u00a0assembly rights<\/a>\u00a0of students and faculty and transform the university into places where people are fearful of speaking out.<\/p>\n In October, the UN Special Rapporteur on the rights to freedom of peaceful assembly and association, Gina Romero,\u00a0criticized these policies and practices, urging universities to change course<\/a>. Romero observed that the \u201cbrutal repression of the university-based protest movement is posing a profound threat to democratic systems and institutions.\u201d<\/p>\n Teaching Palestinian history on campuses is\u00a0essential work<\/a>, especially as schools and universities in Gaza are\u00a0facing scholasticide<\/a>. Scholasticide refers to the \u201csystemic obliteration of education through the arrest, detention or killing of teachers, students and staff and the destruction of educational infrastructure.\u201d<\/p>\n Histories of the Nakba<\/a>\u00a0\u2014 the\u00a0violent displacement<\/a>\u00a0of over 750,000 Palestinians during the founding of Israel \u2014\u00a0have been actively denied<\/a>\u00a0in Israel<\/a>\u00a0and in Western education and public discourse.<\/p>\n The destruction of education is a method of genocide, as education is\u00a0essential to the continuation of the Palestinian people as a distinct national and cultural group<\/a>.
